THE WILL OF THOMAS P. SHALLCROSS Contributed by Marion Shallcross. Ohio County, West Virginia Will Book 7 Page 338, 339, 340, 341 Thomas P. Shallcross Will" Made - 8 July 1891 Proved - 29 August 1891 In the name of God Amen: I Thomas P. Shallcross of the a City of Wheeling State of W. Va. do hereby make publish and declair this to be my last will and testament. First, I give and bequeath to my grand-son Thomas P. Shallcross (son of Elwood W. Shallcross) my gold watch which was presented to me by my brother Samuel S. Shallcross Nov.22, 1883. Second, I give and bequeath to my grand-son Earl Shallcross (son of Alfred P. Shallcross) my gold watch which was presented to me by the Planters Bank of Tenn 1846. Third, I give and bequeath to William Barber (my ward) the sum of fifty dollars. It is my will and I do hereby authorize and direct my executor hereinafter named to sell and dispose of all my real estate in Lyons County, State of Kansas, and in Ohio County state of W Va, and all other real estate owned by me and wheresoever situate (except my Grave Yard or Cemetery property) at public or private sale with such terms as to him shall meet. And that out of the proceeds of such sale or sales he shall distribute and pay to my grand children, children of my son Henry C Shallcross in equal proportions share and share alike one Sixth (1/6) part thereof, to be paid to those of said grand children who are of age, and in the event of any one or more being infants such share or shares shall be paid by my executor to Franklin P Jepson of the City of Wheeling to be held in trust by him for the benefit of such infant or infants until such last mentioned grand child or grand children shall arrive at the age of twenty one years: and upon trust in the meantime to pay the interest on the same to their mother Rebecca Shallcross whose receipt shall be and effectual discharge for the same: and as each of my said grand-children shall become twenty one years of age, the said trustee shall pay to such grand child his or her share of the principal given in trust as aforesaid: And that my executor shall distribute and pay to the said Franklin P. Jepson to be held in trust by him for the sole benefit of my son Thomas P. Shallcross on twelfth (1/12) part thereof for and during his natural life and to pay the annual income to him, and his receipt to be an effectual discharge for the same: Upon the death of the said Thomas P. the said trustee is to pay the whole remaining, to the lawful heirs of the said Thomas P. And that my executor shall distribute & pay to the said Franklin P. Jepson to be held in trust by him for the sole benefit of my grandson Harry Shallcross son of William D Shallcross one sixth (1/6) part thereof until the said Harry shall arrive at the age of twenty one years: and upon trust in the mean time to pay the interest upon the same to his lawful guardian whose receipt shall be a discharge for the same and when the said Harry shall have arrived at the age of twenty one years the said trustee shall pay to him his share given in trust as aforesaid. The said share divided by this will for the benefit of my said grand child Harry is the one sixth (1/6) part thereof, and which my executor is to distribute and pay to the said Jepson in trust as is in this clause mentioned. And that my executor shall distribute and pay to the said Franklin P. Jepson to be held in trust by him for the sole benefit of my grand children, children of my son, Elwood W Shallcross share and share alike and in equal proportions one sixth (1/6) part thereof until such last mentioned grand children shall arrive at the age of twenty one years: and upon trust in the mean time to pay interest on the same to Anna Shallcross their mother whose receipt shall be a discharge for the same and as each of my said last mentioned grand children shall become twenty one years of age the said trustee shall pay to such grand child his or her share given in trust as aforesaid. And that my executor shall distribute & pay to my daughter Annie R. Cowen one twelfth (1/12) part thereof. And that my executor shall distribute and pay to my daughter Sallie B. Shallcross one Sixth (1/6) part thereof. And that my executor shall distribute and pay to my son Alfred P. Shallcross on Sixth (1/6) part thereof. The Last forgoing bequests are to be paid by my executor upon the condition that no claim shall be set up against my estate for any past services rendered by any one of my children, as I have already compensated them and each of them for all services rendered: And I am not liable to them or any of them for or on account of any service heretofore rendered. It is my will and I do hereby authorized and direct my executor herein after named to sell and dispose of all my personal property of every kind and description and wheresoever Situate (not otherwise disposed of in this my will) at public or private sale upon such terms as to him shall seem meet. And that out of the proceeds of such sale or sales of said personal property, he shall first pay my funeral expenses, and all my just debts and that he do retain and invest upon good security a sum not exceeding one hundred & fifty dollars, the interest on such investment to be expended in the care & preservation of my lots & monument in Mount Wood Cemetery, Ohio County, W Va Second that out of the residue of the proceeds of the sale or sales of said personal property my executor shall distribute & pay to my daughter Sallie B. Shallcross two thirds (2/3) thereof: and shall distribute and pay to my daughter Annie R. Cowen on third (1/3) thereof. I order and direct my executor shall deduct and retain out of the portion or interest in my estate bequeath by this will to or for the benefit of my son Alfred P. Shallcross any and all monies that he as my executor may be called upon to pay by reason of any endorsement on any paper or papers I my have made for said Alfred P. I also order and direct that my executor shall deduct and retain out of the portion or interest in my estate bequeathed by this will to or for the benefit of my grandson Harry, son of My son William D. Shallcross one hundred dollars: and any and all monies that he as my executor may be called upon to pay by reason of any of my endorsement on any paper or papers that I have made for the said William D. Shallcross. I hereby appoint Judge John J. Jacob of the City of Wheeling W Va. my sold executor of this my last will and testament, hereby revoking all former wills made by me.
