THE WILL OF PETER DAYLEY/DAILEY Submitted by John McDonald of Murray, KY. This is the Ohio County, VA/WV will of Peter Dayley/Dailey (1762-1804) who married Mary Ann Wiley. Peter Dailey was a Rev. War soldier in Washington County, PA according to "The Ten Mile Country and Its Pioneer Families," by Howard L. Leckey. From Ohio County Will Book 1 (typos and spelling mistakes included): In the name of God amen I peter Daily of Ohio County and state of Virginia being weak and low in body but of perfect mind and memory thanks be given to God for his meroies and recollecting that it is appointed for all men once to die do constitute this my last will and testament in manner and form following that is to say first and principally I recommend my soul into the hands of almighty God who gave it me and my body to the Earth from whence it came to be buried in a christian like manner a the discretion of my surviving friends. and as to my worldly estate wherewith it has pleased God to bless me in this preasent life I will and bequeath in the following maner towit --- Imprimis (I will and bequeath unto my wife mary Daily Two milf cows and my household furniture to her and hers forever --- Item it is my will and desire and I give and bequeath unto my present five sons Joh Peter Esau Jacob and Jesse Daily the plantation whereon I now live lying in Ohio county and state of virginia to be equally divided to them severally at their respectfully arriving at the age of twenty one years by my Executors herin after mentioned and their heirs forever and the said plantation to be rented out by my executors and the profits arising therefrom to be equally divided among my five sons above named as my executors may think most to their beifit --- Item It is my will and desire that my executors see my sons put to such Trades as the make choice of as soon as convenient. after my decease Item it is my will and desire that my daughter Mary and Nancy be bound by my executors to reputable people such as they in their direction may make choice of --- Item it is my will and desire that my executors herin after named proceed after my decease to dispose of all my personal property not mentioned in this will and after paying all my just debt and obtaining/a deed in my Sons names to the land mentioned in this my will to divide the balance equally betwen my five sons above named when they arrive of age --- lastly I nominate constitute and appoint my respected friends Jeremiah Williams and Elis Thomas both of Ohio County the executors of this my last will and Testament revoking and disanulling any will or wills by me heretofore made and declaring this to be my last will and testament in Testimony whereof I have hereunto set my hand and seal this 7th day of february 1804 Peter (his mark) Dayley Wittness names Elsey Swangum Bazel Riggs
