The submitter has given permission to the USGenWeb Archives to store the file permanently for free access. http://www.rootsweb.com/~usgenweb *********************************************************************** In the name of God Amen, I Allen D Huddleston of County of Fayette State of West Virginia do make this my last Will and Testament as follows: First: I desire that my body may be decently buried without needless expense, in a manner corresponding to my estate and situation in life, Secondly: I direct that all my just debts be paid as soon after my decease as conveniently may be, and to that end charge my whole estate, real and personal with the same, Thirdly: I give and bequeath unto my daughters, Elizabeth the wife of Jno Waters, Alice the wife of Jno Creasey, Ruth-Ellen the wife of Wm McCombs each the sum of Four Hundred Dollars ($400.00), Fourthly: I give and bequeath unto "Josie" whom I recognize as my grand daughter, she being the daughter of my son Joseph Huddleston deceased, the like sum of Four Hundred Dollars ($400.00). And with intent, and for the purpose of securing payment, I hereby charge any real and personal estate with the bequests herinabove made of Four Hundred Dollars each to my said three daughters and my said grand daughter, Fifthly: I give devise and bequeath to my Executors hereinafter named, all my lands tenements mesuages[?] situate and being in Fayette County, West Virginia, with the appurtenances thereto belonging or appertaining, to-gether with all the fixtures, horses, cattle, furniture, agricultural and other implements of all kinds commonly used therewith and being thereupon or belonging thereto, at the time of my decease, to hold to my Executors for and during the widow hood of my beloved wife Mary Huddleston, and if my said wife re-marry or die leaving my sons Stephen R and my grand daughter Josie above named, then and in either of these events my said Executors are to hold the property above devised and bequeathed to them until my said son Stephen R and my said grand daughter Josie respectively attain the age of twenty one years, or until the marriage of my said grand-daughter if that event occurs prior to her attaining twenty one years of age. But upon trust nevertheless to collect the rents, issues and profits, and in every way to manage as their own of the real and personal property hereinabove devised and bequeathed to them, and out of the rents, issues and profits accruing from said property, to provide food and clothing and all other necessaries of life, for my said wife for all the time and only so long as she remains my widow. And my Executors are like wise directed, out of the rents issues and profits arising from the aforesaid property to like wise provide food and clothing, and all other necessaries of life, for my said son Stephen R during his minority, and likewise food and clothing and all other necessaries of life for my said grand daughter Josie during her minority or until she marries if that first occur. And after the death of my said wife or after she has remarried, if that event occur and like wise after my said son Stephen R attains twenty one years of age, and like wise my grand daughter Josie has attained twenty one years or has married under twenty one years of age, my said Executors are to divide the entire property herein devised and bequeathed to them equally among my five sons, Henry O, Alonzo B, Edward T, James A, and Stephen R assigning to each one, by lot, one fifth of all said property, or if my said Executors deem it advisable they are hereby empowered to sell all of said property, and divide the proceeds equally among my said five sons. And if the devise herein made to each of my five sons lapses, his or their portions are to go equally to my sons or their representatives who are then surviving. I authorize and intend this writing on the margin. Allen D Huddleston Allen D Huddleston Sixthly: And at the death of my beloved wife, she dying as my widow, I request and direct that any said Executors, out of the property above devised and bequeathed to them, or out of its rents, issues and profits, shall provide for her decent and proper burial. Also likewise to provide for the burial of my son Stephen R, if he die under twenty one years of age. And also to provide for the burial of my grand daughter Josie, if she die under twenty one years of age and unmarried. Seventhly: I do appoint Alonzo B Huddleston and Daniel Nihoof to be executors of this my last will and testament and I direct that they shall neither of them be required to give any security for the faithful execution thereof. Eighly: I hereby revoke all other and former wills or codicils, by me at any time heretofore made. Witness my hand which I have set to this my will written upon five sheets of paper, signing every sheet thereof this 1st day of April in the year 1887.
